Visitation
I have a 19 month old child and her father and I were never married. He is currently moving in with a new girlfriend and demands that I allow visitation there over night. I recieve child support that was determined by the courts because I had to have county assistance. His girlfriend is not a citizen of the US. Isn't this a hazard for kidnapping? He is also talking about getting married which would give him dual citizenship. I thought there was some law on this. I was also curious that since I recieve the child support does that give me sole physical custody because it was not directly stated in the support court papers. Thank you for your time.

The child support papers didn't need to make a custody award to you because Minnesota statutes automatically give unwed mothers sole custody and access rights to their children. The father has no visitation rights unless and until he petitions a court for them and a judge decides to grant him some.
