Visitation Rights/Parental Rights

I have been divorced from X since 1994. However, X has been diagnosed with Bipolar disorder and had very little contact with our child. She is now in California. In 2000 I went back to court and was granted full legal and phyisical custody. But she was granted supervised visitation. X has not seen child since 1997 or talked to child since 1999. However, when she did talked to child, she only made him upset and tells him very bad things about me and my fiance. would like to stop this and remove her parental and visitation rights. Is it possible?

You may terminate parental rights if there is a compelling reason and it is in the child's best interests. To be safe, you may want to consult with a child psychologist and take that recommendation to Court as part of your case.

Courts are reluctant to terminate parental rights in most cases. However, where there has been an absentee parent for an extended period it is possible. In fact, abandonment is listed as a reason for a TPR under Minnesota's statute.
