Thank you for your question. You do not have to be represented when you enter mediation, but you should have a lawyer. The problem is that, without the help of a lawyer, you are going into mediation "blind." I don't know whether your case involves custody, child support, or spousal maintenance issues. But even if your case only involves property division, and particularly if there are pension plans or retirement savings involved, you should be represented by a lawyer. Otherwise, you will not necessarily know what is reasonable, what to give up, and what you should insist upon. Further, you cannot assume that a mediator will be there to help you. A mediator cannot give you legal advice, and even if the mediator gives you some guidance, he (or she) is not there to assist you. Yes, you should hire a lawyer.
