last will and testament
My daughters father passed away. He had a will drafted 5 years ago when his identical twin brother died 5 yrs ago. On his death bed he told my daughter that she will be executor since she is his oldest child. They have searched his house, but cannot find name of lawyer he used, or a copy of his will. There is a huge rolodex, but no one listed as an attorney. Are last wills registered at courthouses? This in the Mpls, MN area, MN laws apply. He worked for the City of MPLS as well. How can we find who his attorney was?

It is likely that there is no way to find the lawyer who drafted the Will without some reference on some document. However, your daughter is still her father's heir. Are there other children or a surviving spouse? If not, your daughter would be his sole heir and entitled to all of his estate regardless if there is a Will or not. If there are other children andor a surviving spouse, your daughter would still be entitled to a share of the estate. You need to begin a probate and have a personal representative (executor)appointed who could be your daughter if she is old enough. Retain an attorney. Dennis
