Legal Question in Civil Litigation in Minnesota

My boyfriend and I live in a condo that had a lease but was never renewed. We continued to live in the unit each paying half the rent. My boyfriend moved out without notifing either myself or my landlord. He has been gone for 2 months, he left July 2nd, paid that months rent. During that month we had contact and he led me to believe that we would work things out. I then discovered in August that he had a new girlfriend(since April). I cut all contact. I then sent him an email requesting that he pay his share of the rent since there was no notification amongst other things he owed me. I offered to negotiate payment. I received an email a few days later from him suggesting he move back in until October and when could he get the keys. I do not want him to move in, I feel that he is just trying to call my bluff, I am not bluffing, but I do not know how to respond. Do I have to let him move or can I continue to pursue the request for payment. I guess my question is he has been gone owes me for rent and now to avoid having to pay extra money his solution would be to move back in for 2 months. I do not think his moving back in would be healthy for each of us. Thanks

I am afraid you cannot have it both ways. If you have an agreement that he pays half the rent on a month to mnth lease, he could be liable for one half the rent the month following his relocation. If you choose to continue residing at the same residence and wish to continue charguing him rent, he remains a tenant and can move back in.
