Legal Question in Civil Litigation in Minnesota

My Goods

On 16 Nov 06 I was served a warrant to look for ''child pornography'' They took everything they could think of that may have child porn connected to me: Computer, camera, paper work, etc. I now have a new computer and want my things back. How do I proceed to find the status of my case?

It depends on the prosecuting authority. I would need to see the Warrant to advise. There are methods of retrieving the property once a decision NOT to prosecute has been made. Let me know if you wish assistance.

First, your computer, discs and other equipment will not be returned so long as there is an ongoing investigation. That investigation generally takes several months since they must make a mirror image of your hard drive and then complete a forensic search for contraband images.

If the investigation has been concluded and no contraband is found, your equipment is generally returned. If it is not, you may be required to sue the county seeking its return.

A child pornography charge is very serious and can resuolt in prison time as well as reporting as a sexual offender.
