Legal Question in Civil Litigation in Minnesota

Lawsuit

We have a small business that coats and repairs hog slat flooring in barns. In 2006 we had a farmer request a special coating because of the milk he fed, it ate the concrete. After months of research for the right product, we were convinced that polyerea coating on stats would solve the problems. After researching suppliers we narrowed it down to the one who would gaurantee the product would not come off. The assured the farmer and us with this guarentee and were also at the site when it was applied to make sure procedures were correct. When the product started to fail, the salesman and the tech dept. went out to look at it, and assured us and the farmer that they would stand behind the product. When the barn became availabel to repair, they basically told us that they were not doing anything and we'd have to sue them. Where do we go from here???

Re: Lawsuit

I would want to bring in an evaluation expert re: cost or repair confirmation, then issue Demand Letter, along with Claim for Coverage under available Warranty and Insurance coverages. Litigation would be last resort ( and Mediation might be an appropriate and cost effective alternative.)

I have 25 years Business Law experience.
