Legal Question in Civil Litigation in Minnesota
I have a litigation question. I paid my aunt cash for a horse trailer. I have witnesses that seen me pay her the money. I had the trailer, but was waiting for her to find the title. Without me knowing, she came and got the trailer and resold it to someone else. Now I am out a trailer and the money. I've been trying to contact her but of course she is avoiding me.

If you paid her for the trailer and she later sold the trailer to another, you should be able to sue for the cash or the value of the trailer. It may be a bit difficult to prove that the transaction occured, but if you have a witness and/or documentation proving that you withdrew cash from an account for the transaction, you may be OK. Further, the value of the suit will determine whether you must sue in district court or conciliation court. Is the trailer or cash expended $7,500.00 or less (conciliation court) or over $7,500.00 (district court)? You may want to consult with a qualified attorney.
