It depends on the circumstances. If you are being recorded in a public place, where others can hear you, then the police and anyone else can record what you say. Or, if you are being questioned by the police, they can record you without your knowledge. In fact, many squad cars are equipped with microphones and cameras that record discussions with anyone in range. (Ever seen "Cops!") That is legal.

The only question is whether statements are recorded where you have an expectation of privacy, such as on the telephone. In those instances (barring something otherwise justified under the patriot act, or other extraordinary circumstances), warrants are generally required, but even then, the recording will take place without your knowledge.
