Legal Question in Civil Litigation in Minnesota

Text Messages Admissible?

Are text messages admissible in court as proof of intent to payback a loan? I received test messages from a person I loaned money to stating that they would pay me back. Now they're claiming that they never received any money from me.

Re: Text Messages Admissible?

There is no rule specifically prohibiting use of text messages and in fact, the Rules were recently amended to address some of the issues relating to electronic communications. In all situations, before evidence is admitted the person offering the evidence has to provide a "foundation" of testimony that establishes the evidence is what it purports to be. If you are able to show that the text message was received on your phone or computer, and that the original message came from the borrower's machine, chances are pretty good that you will be able to introduce the message into evidence.
