Legal Question in Civil Litigation in Minnesota
Will I have to give my dog back?
I had to sell my two Chihuahuas and listed them in the paper. A woman paid $600. cash no receipt. Two months later she said she had to move, could only take her dog. I was upset so she said she'd bring them back and I could pay her in pmts. when I could. She brought the dogs back and left without any kind of agreement when and how much I would pay her, she just dropped them off, said to pay her when I could and left. My cousin, Stacey took one of the dogs and was going to pay 3-05 after taxes. I agreed. At least he'd be safe there. She called me later and said she wanted money. I said my financial situation is the same (I worked at the police station, but it was an unpd. internship). When I got the job I'd pay her. Two weeks later she and her daughter came barging into my home and were cussing and making threats, my children were so scared. They demanded the dogs. When I said the one was at Stacey's, she became irate. She snatched the other little dog up and made more threats. I asked her to leave many times. I wrote a letter to her stating she was not welcome in my home and to stay away. She is taking me to court for the dog. Stacey won't hand him over and offered to pay. The lady agreed then said no, she wanted the dog. HELP!

You should countersue for breach of contract and trespass.
This demonstrates why written contracts are always advisable.
