Legal Question in Immigration Law in Minnesota

Deportation

I have been married to a U.S Citizen for almost 3years. We did not have the money to file the paper work right way. We also have a daughter together. I filed my paper work about 2mths ago. Before doing that i filed a form that i had to get a hold of my I94 from Homeland security. My passport was stoled years ago. I did get a copy of my I94 and then filed my paperwork. Six months later I recived a Action of Removal and I just got a letter with a set court day. I have already done my figure printing and waiting for my work permit and SS card. The form that they have send me is also in my maidian name not use if they know that I am married and have filed my papper work. I am not sure what can happen here. Can you please give me some advise on what I should do. And what can happen.

You may be able to terminate removal proceedings and continue to process your case with USCIS, but I would have to review all of your paperwork to confirm.

You may be eligible for relief from removal based on your marriage, but we would need to analyze your case closely before advising.

Dear Inquirer:

Since you overstayed your visa, you are technically removable from the US. You may apply for adjustment of status to green card as relief from removal, however, and the Immigration Judge may grant you that relief in court.
