Immigration Laws /marrying a US citizen

I found out recently that my niece is marrying a person from a foreign country, he is a student and I do not know his status. I think the man is using my niece in order to stay in the US, but she is unaware of his motives. what if she marries this person and then find out it was a a ruse on his part? Will she be in trouble?

If she can prove she entered into the relationship in "good faith", it is unlikely she will get in trouble.
