Legal Question in Immigration Law in Minnesota

Would it be better to file an application for foreign husband to become legal resident in minnesota or to return to mexico, remarry his wife, a US citizen, and apply for visa to enter US legally. He is currently living in minnesota. he has been married to US citizen for almost 2 yrs. Also would 2 DWIs and 2 yrs probation affect his chances of becoming legal?

If he has entered the country legally...then he should apply for adjustment here. Also...DUI would not be a problem.
