Legal Question in Immigration Law in Minnesota

Will my husband be sent to country of origin during process

I recently got married to a Mexican citizen and we are getting ready to start the immmigration process. I have heard from other couples in the same sitation that the foreign spouse is deported to their country of origin during the immigration process, (usually about nine months) and left there until they receive their green card to enter into the country legally. Is there any truth to that, and if so can we pay a fee to keep him here during the process.

Thank you for your time,

Concerned wife

If the person has entered illegally, then they can voluntarily leave the country while their application and waiver of excludability are pending. If they are deported, then they will also need to apply for a waiver.

If he is here legally and you are an US citizen..then he can live here...if not he can go back and wait or wait here after it is approved and go back there to receive the green card and wait there at that time for the waiver to be approved.
