If your fiance entered the United States illegally, the current immigration law generally does not allow him to adjust his status from within the U.S. In such a case, he would eventually need to leave the U.S. to acquire a visa from the U.S. consulate in Mexico. A case of this type requires detailed analysis and planning.

Re: hi

Since you are US Citizen...you can apply for him after you get married. If he has entered the coutry with a visa...no need for him to go back to Mexico. If he has entered without inspection...he needs to go back to Mexico for the final interview.
