Legal Question in Employment Law in Minnesota
Hello. I have a business misrepresentation question. I was approached by a friend and colleague with a work opportunity, we would be working as 1099 general contractors through a company called CS communications, who contracts for time warner. I was informed of the pay, that the contracts have been secured and when the start date would be. I passed the background and drug screen required. I was told we would begin our project in San Antonio on May 25th. I quit my job and that date came along and the project was delayed a week but we had to be in San Antonio on thursday the 28th according to time warner to be scheduled for the following week. We were paying for our hotel rooms, gas, everything ourselves. That week passed with various excuses given by Randy of Cs communications, and assured the next day we would start. After a week Randy told us to move to Wilmington north carolina again at our own expense and were told we would start on June 8th. This of course again was false and we sat in hotels the entire week with again no work, but was tokd again and again the work would begin the next day. Was told it would start the 15th. Same scenario. Now told it will begin in the 22nd. We are all in debt close to 5,000 due to these delays. And obviously our spirits are low. Is there anything we can do? Is this misrepresentation by this ds technologies group?
1 Answer from Attorneys
Further details would need to be known in order to sort out which state, or states, law may govern; In some situations, multiple states may be potential locales to initiating legal action, and that then leads to issues as to which is the 'preferred forum'. You may pay an experienced attorney to provide you with formal, detailed legal advice and counsel: Provide her with copies of all 'paper trail' sorts of documentation. Be very wary of 'free advice'. It sure sounds as tho' you have a whole lot of losses and they're only continuing to accrue. Too, realize you are missing actual, 'real', 'authentic' employment possibilities through this time you choose to continue down the path you're walking. I don't know what the supposed 'payoff' is to be, in relation to all your ongoing actual losses. Do be aware that sadly, situations such as you describe do occur with regularity. This is a 'ive and learn' experience, for sure. I suggest to you that likely 'trusted elders' would be great people for each of you 'victims' to approach for wisdom and advice - persons such as seasoned successful business persons, more like older than you (I am guessing you are not very old...)
Best to you.
