Legal Question in Employment Law in Minnesota

Employee rights when positions are eliminated

I am inquiring about the legal rights of an employee with six years of service with a company in the same position when the employer has decided to eliminate the position. Is there are legal actions I can take to force my employer to transfer me to another position at my same wage, etc.

Thank you for your Help.

Sincerely,

Tracie

Re: Employee rights when positions are eliminated

You have not given enough information to answer this question. As a general rule employees are "at will employees" and can be laid off or terminated for any legitimate business reason, as long as it is

nondiscriminatory. Exceptions to this rule include a specific written

contract hiring you for a definite length of time. This would include union contracts, or in the case of some Universities, tenured employees.

We do a free initial consultation if you wish to pursue this further.

Are you in a union? DO you have an employement contract or employee manual? I would have to review situation to advise.Generally if you could quit without notice you can be fired without notice, for any legal reason.
