Not getting FLMA

My significant other had breast cancer. Her boss at the time wanted her to be available to the company, so he paid her full wages. After He left the H.R. Department put her on disability and still requested that she be available for work. Her health, and recovery have suffered because of working instead of having time off for recovery. Now they are threatening her about her attendance for seeking continued health care.

What is her recourse? If she had been granted FLMA, she would most likely be healthier now than she is.

Re: Not getting FLMA

In addition to FLMA coverage, there may be an ADA issue.

I would like to see the employee manual/handbook re: leave etc.
