Forced to use a vacation benefit.

I work for an agricultural manufacturing company in central Minnesota. As part of a benefit package, they offer what they call PTO (Personal Time Off). This amount of time varies for the number of years employed, and it counts as both sick and vacation time. The company has made the decision to close the facility for 1 week over Christmas and New Years. The company is forcing any employee that has PTO time to use it for that week of shut-down. They have forced employees before to use PTO time when the company has shut down for 1-2 days for other various holidays. Can a company force you to use what they say is a ''benefit'' when they decide to close thier doors for a certain amount of time?

I would have to review your Employment Contract {usually in the form of an Employee Handbook or Manual} to answer your question. The easy answer is that if you are able to , use the PTO BEFORE the mandatory layoff period, then they will not be able to use it for that time.
