Possibly. Just because one position is eliminated ( perhaps a sales mgr) doesn't mean that the person formerly holding that position couldn't do damage by competing in the marketplace.
I would need to review the document and find out the circumstances more in depth to fully advise.
I have enforced and nullified non-competes in my past representation of clients, and it is a somewhat technical area of law.
