Legal Question in Employment Law in Minnesota

unemployment

I am an apprentice electrician and for the past 14 months my employer has been 1099'ing me. i was reciently advised that this is illegal for him to do because i am not a licensed electrical contractor and cannot be subcontracted because of this. i was told that he is evading unemployment insurance and workmans comp as well as taxes. i was laid off 3 months ago and didnt think i was eligable for any kind of unemployment benefits so i never applied. my questions are: 1. was it illegal for him to 1099 me? 2. if so, what are the implications of him doing so? 3. do i qualify for benefits? 4. if so, how would i address this issue when applying for benefits? thank you in advance for offering this service i havent been able to find definitive answers anywhere and am at my wits end. your council is very greatly appreciated.

Make application for UE benefits. You can do so online.

If they deny or the employer denies, you will need to document your status and the employer will likely be tagged. Call or email for assistance.
