Legal Question in Employment Law in Minnesota

I work in Minnesota for a South Dakota corporation. My noncompete employment agreement states "governed by the laws of South Dakota". Is that enforceable in Minnesota - the noncompete "within 25 miles of the city in which employee is employed"

QUite possibly not. I would have to review the agreement to advise. If it is considered unreasonable, it will be modified by the court to make it reasonable. Depends on the industry and the business interest sought to be protected.

Generally, there is a requirement of reasonable to such agreements. Consideration is required. The issues are typically quite fact dependent. Do confer with an attorney so she/he can review the agreement and situation and circumstances and she/he can then advise you.
