Legal Question in Landlord & Tenant Law in Minnesota

breaking a lease prior to moving into a rental property

my family was looking for a house to rent. we located one that was occupied and we did not have a chance to view the home as an empty unoccupied dwelling. upon signing the lease we in good faith were willing to move into the dwelling, however the house is Cat urine filled air and moldy windows and skylights. My wife, daughter and i are allergic to cats and cat urine and the mold on the window sills, we could not stand in the house for more than 10 minutes without having respitory difficulties. we demanded out $$$ back. the landlord does not want to return the $$$ stating we signed the lease and he will put in an air exchanger. we feel this is not acceptable solution. what are our rights. we asked for our $$ prior to moving into the dwelling.

You may in breach of lease, but may have a defense, if a reasonable person would not live there. Did you let the LL know of your allergy?

Did you not visit the premises before you signed?

Call or e-mail for further assistance.

I have been a landlord for 25 years.
