Legal Question in Landlord & Tenant Law in Minnesota

Getting my damage deposit from my landlord.

I was living with a roommate in a basement with our landlord who owened the house we were in living above us. We decided to move out August 1st of this year so gave a notice to our landlord before July 1st. I was told by my landlord that we were ''good'' tenants and that I'd receive my damage deposit once he gets a new tenant. I called him a month or two after we moved out and he said that he had just gotten a new tenant and that the check would be in the mail soon. I still haven't received my money and it has now been 3 and a half months.

I have a signed damage deposit form stating that the landlord must give the money back or a portion of it back after given notice and things are all in order. What can I do? Is there any chance I could take the landlord to small claims court?

Another small hitch is that the landlord was maarried and his wife left him during our stay at his place. Her name is on the damage deposit form, so I suppose if I did take this to small claims I would be taking his wife to court.

Any info would be great! $500 would be very nice to have right now so looking for any good options!

Take him to Conciliation Court. There are penalties involved if the deposit (or reasons why you're not getting it) is not given to you 21 days after either move out or the date you provide a forwarding address (whichever is later).
