Legal Question in Landlord & Tenant Law in Minnesota
return of security deposit
My aunt passed away in her apt. on oct 12th 2008. The landlord is refusing to return the damage deposit due to the fact that she broke her lease. This landlord never had any of the repairs done on the apt. She also told us that she does not have to give back to deposit because there is no move outs between certain months. Is there a law in minnesota that states that because she did not finish her lease they dont have to give her deposit back.

I would need to review lease, but death typically terminates lease. Rent obligation of estate would be extinguished at end of month following death.
