tenant moving out and suing landlord

We rent a house to 5 students. One moved out at the end of the lease, so the other 4 found a new one to sign the new lease for 1 year. We got the damage deposit and 1 month rent and when she was to move, she was told by the other girls she was to stay in a certain room that was not a legal bedroom. She did not move in and took us to small claims court. We won because they all rented the whole house and not a particular room. We received the judment for 3 months rent. Then, she took us to court to recover the money because we did not have a rental license at the time. We won again. Now she is appealing the decision to district court. We have not received rent from that person for 5 months. Can we countersue for the loss of rent for those months? And would it be a good idea?

Yes you can bring a Counter-Claim in District Court. The rules in District Court are more formal and if you are incorporated you MUST Be represented by counsel.
