Legal Question in Landlord & Tenant Law in Minnesota

Tennant Landlord dispute

My daughter and I rented from same person. She and her ex-boyfriend moved out and were taken to court. Landlord won judgement. Daughter moved in with me, land lord demands I pay her judgement or she may not stay with me. i Modified the agreement he sent me to sign, stating I would make the monthly payment as long as she was staying with me on the property. His secretary accepted check and I have recpt. Today he said he does not agree with the stipulation and wants me to co-sign for the total amount owed. Also I would like to break lease agreement. This is a brand new basement apt. landlord said he spent $10,000, to sound proof the noise is so loud, I have to wear earplugs to sleep. I have told him and he says I'm lieing. If the kids upstairs run across floor it sound like elephants. Can I use this to break my lease? I have aked him repeatedly to listen and he refuses. The noise is so loud it makes you jump. I just don't know what to do. I rented another apt and he was fine. I have NEVER been late with my rent and when the washer broke and he charged me for the repair, I payed him right away. Today I told him when my lease was up I would be moving, he said when is it up, I said not soon enough. Do I have any rights?

Re: Tennant Landlord dispute

It is necessary that I review your written lease to advise you. I have been a landlord for 25 years. The noise you complain of would NOT be a basis for breaking a lease. The answer is to have it abated by the LL and/or the police if necessary.
