My ex and I own a house together, I want her to buy me out, can I force her to?
My ex wife and I own a home together. She lives in it. We have no small children, they are all grown up. I have a Barber shop attached to the front of the home. I have been paying half of the bills with her. I am 72 years old and need to retire, my health is not the best. I asked her to buy me out and she refused. She said she couldn't afford a mortgage, we own the house. I gave her a solution of a reverse mortgage and she still refuses. I cannot continue to work for much longer and the money from the house is my retirement. I have no other money. Can I force her to sell or buy me out. The house is worth $200,000.00 or more. I told her if she got a reverse mortgage I would settle for $75,000.00. She still refuses, she doesn't want be to benifit from anything. I am remarried and she is bitter.Also my new wife and I adopted her grandson after her daughter died so we really need the money. Any suggestions?

In Minnesota a lawsuit can be started to sell the property. This is called a partition action. If the parties cannot settle the dispute a trial could be held and a judge would decide if the property must be sold and the judge can decide how proceeds can be divided. This can be expensive and a negotiated settlement might be preferable. Your divorce decree should state how the property is to be disposed of. If it does the decree might spell out each of your rights in relation to the property. Good luck to you.
