Defamation of Character / Slander
My brother spread some rumors about my husband & the rumors have affected his relationships with my family. How do you prove defamation of character & do I have to show/prove some sort of alienation? My brother started spreading these rumors before our marriage, hoping to put a strain on our relationship because my brother sexually abused me [which is documented] & I believe he worked very hard for many years successfully destroying other relationships I�ve had because he did not want me with any other man, hoping/trying to keep his �secret.� Other family members have told me what he said and I know I have enough proof that my brothers defamation has affected our family relationships because of the �sides� everyone has been forced to take. When we do rarely show up at events my brother leaves, embarrassing us before he goes. I just need to know what has to be proven in order to show cause that his slander & defamation has created significant changes in our family relationships. He refused therapy & this has been going on for too long. I'm 44 & the strain of loosing my family isdevastating. My brother does have assets, he owns several commercial buildings. I just don�t know what type of lawyer to talk to. Thanks!

Alienation is not an actionable offense. Defamation would require, in most cases, that the person made a false statement or a statement in reckless disregard of the truth and that as a result, you sustained quantifiable damages. Certain statements are protected including any opinions or comments made with a humorous or satirical intent.
Based on your brief post, it is not particlarly likely that you would have a viable legal action both from the standpoint of liability and damages.
