Legal Question in Personal Injury in Minnesota
Pedestrian hit by city bus- settlement question
I was hit by a city bus while crossing at a temporary pedestrian crosswalk, resulting in broken bones & dislocations in my right hand & arm. The surgeon involved has produced paperwork for both sides stating I will need to have further surgeries on my nerves in my hand & wrist. How do we ensure that the bus company will pay the future medical bills, and that it does not become my responsibility? (I am a 27 year old sculptor requiring at least 2 more nerve surgeries - I don't want to be 55 & paying for my further nerve work because of this accident)

Re: Pedestrian hit by city bus- settlement question
I agree with Mr. Kohler that it is unlikely that the insurance company will leave your benefits open and pay an additional amount to settle your case. Usually the insurance company will settle the case on a "full and final settlement" basis. That means that 8 months from the settlement, if you are cured, you do not need to pay the insurance company back money that they paid in anticipation of a future surgery. Unfortunately, it also means that if you need an additional, unforeseen surgery, the insurance company will not pay for that as the case has settled.
Many times people will contact me and I tell them that they may be capable of resolving their own cases without having an attorney. If you are represented by an attorney, you should discuss these issues with him or her until you are satisfied with his or her answer. That information is part of the reason that you hired an attorney.
If you do not have an attorney, I would be happy to discuss your case with you. A professional sculptor who has a serious hand injury is facing a life-changing case. In a life-changing case like yours, I believe that professional representation is required. If not from me, then from another experienced pedestrian accident attorney. Best wishes and I hope that I have helped you.
