I was pulling a loaded trailer
and my truck airplaned, spinning me in a right circle I ended up rolling my triuck and in the ditch facing the direction I was coming from. because it was in august I was in the process of finishing paint jobs from the summer and did not have time to go to the hospital or doctor my shoulder and neck hurt some what but not unbaerable... until I fell asleep one night on arm and woke up I had NO feeling in my right arm at all...I went to a chiropractor and he said I had a pinched nerve, since then I have seen several doctors, done extensive theropy, have had MRI's and been advised of surgery. My health care is Minnesota Blue Plus and they have been flipping the bill until a doctor noted that this was due to an auto accident. Blue Plus then denied all payment and contacted ALLSTATE Insurance.. They had me see their doctor and he said that the neck injury was not from the accident..NOW noone will pay my medical my credit is (was) good untill these bills all started pouring in. Auto paid for my truck (I had full coverage) but will not pay medical.. please advise me what to do...I am a house painter. I am my own business and it is now to the point surgey is inevitable.

You will have received a notice letter from Allstate informing you of your right to arbitrate to attempt to get the bills paid. If you are going to do that, you should retain an attorney to represent you. An attorney will file the claim for you and, if you prevail at arbitration, the attorney's fee will be paid from the award. Of course if you lose, the attorney does not charge you.

Your own no fault insurance should pay for your medical and wage loss. However, you will likely need to arbitrate your claim. Health insurance may pay if is informed of the denial by no fault. Contact me if you are in the Southern Minnesota area. I would be happy to help you.

Since this is a one vehicle accident, you cannot sue another person for your injury, unless you claim there was something about your vehicle that caused the collision. You could hire a personal injury lawyer to make a claim against Allstate, your no-fault carrier, in an arbitration hearing. In that hearing an independent lawyer serving as arbitrator will determine if the bills are your responsibility or Allstate's responsibility. Please contact me if you have further questions.
