What are my rights?
I was assaulted by a bartender in a bar. He heard that I said negative things about him. I was sober, and at a table with friends. After initial attack, bouncers joined in. I went to the hospital the following day, I received cuts to my forehead, nose, arm, 4 bruised ribs from being kicked on the ground, and a sprained ankle. I was NOT intoxicated nor were my friends. This was completely unprovoked by myself as I don't even know this man. I did not lose work as I am a full time student. I photographed my injuries the following day. What besides medical reimbursement am I entitled to. Can I sue for any pain and suffering? Thank You.

You have the right to bring a claim against the bartender and bouncers for assault to recover for you medical expenses and pain and suffering. However, it is often difficult to get a recovery in these situations. When a person does something intentionally, like assaulting another person, any insurance coverage they may have is usually lost because most policies exclude intentional acts. This means you can sue the bartender but even if you get a judgment against him you will often have a tough time actually getting the money. You can garnish his wages but the amount you will receive is limited. Often your best bet is to have criminal charges brought for the assault and get the court to order restitution for your injuries.
