Legal Question in Personal Injury in Minnesota

SUV Auto Accident

My 13 year old son and I were involved in a auto accident this past July in Minnesota. The other person failed to yeild a stop sign and hit my rear tire causing us to rollover. My vehicle was totaled.

I sustained a major blow to the head and my son sustained a major laceration to his arm.

I suffered a bout with vertigo for about 2 months after accident and was treated for it.

Minus ambulance and xrays, my medical costs have not been enough to qualify for ''personal injury''.

Q1: Am I eligible for any form of settlement for pain and suffering anyway??? This was a very traumatic accident and vertigo is not something I wish upon anyone.

My son will qualify and in-time we will make sure he receives a settlement.

Q2: Can a person sue the auto industry because it was an SUV?

You can make a claim against the insurance company and if they settle with you then that is great. If they do not settle with you, then you would need to start a lawsuit. Under MN law you could only bring a lawsuit if you have met one of the thresholds. A doctor's opinion that you have a permanent injury may suffice.

You can sue the manufacturer if the SUV was defective and the defect contributed or caused your injury.

In your son's case, I recommend seeking legal counsel with an attorney experienced in representing injured children.
