Legal Question in Real Estate Law in Minnesota
assessments
can we legally be assess for a road that is being paved even though it does not come within 75' feet of our property? we are on a dead end road & they don't maintain the road in front of our property, which is a township road because they consider it undeveloped. If so, can we be assess twice if the road pass our property is developed?

Response: How close the road comes is not the standard governing the assessment. The thing that qualifies your land for the assessment is that the value of your property benefits from the road. If paving or improving some other road benefits your property too, then sure you can be assessed again for that.
The notice of assessment should have information about how to contest or appeal the assessment. If you can show the improvement has no effect upon your propterty whatsoever, or even if it's worth less to you than they say it is, you should consider fighting it - and you should go to an attorney for help with that.
Good luck.
