Legal Question in Real Estate Law in Minnesota

my right to know break down of foreclosure fees

My home went into foreclosure last fall but I qualified for a hardship & received from my mortgage company a total amount needed to get my account current. No breakdown of what/who the charges were for was provided. I had previously received payment amounts from their atty with breakdown of charges. I have written my mortgage company twice asking for it, no response other than payments were made current & rest went in a suspense acct. I disagree with at least 1 charge on atty's list but my dispute will be with mortgage company. Also asked what each charge was, when & how many property inspections were done & why the charges varied. I never got served, I want to verify publication charges & I asked which charges were for the atty & which were for the mortgage company. Am I legally entitled to this info? I was told during the hardship process I was entitled to the info but not to dispute anything until payment schedule was complete or the process would stop & foreclosure would continue. I called their atty and requested the same but no response. Also, can I dispute publication costs if newspaper didn't post legal notice on their website as required by MN Statute Chapt 331A.02 subd 5? Hope you can help. JL

Assuming you are the mortgagor and not a third party, you are entitled to the information. I would contact the appropriate regulatory agency (probasbly Minnesota Dept. of Commerce) to see if they could be of help. If not, you will probably need to hire an attorney.
