Legal Question in Real Estate Law in Minnesota

Breaking Lease for Safety

I have a one year lease agreement. I have decided to break the lease because of some drive bye shootings. Is there any law on my side that can support me breaking the lease, without being sued?

Re: Breaking Lease for Safety

There is an old common law theory called "constructive eviction." You would have to show that the place became uninhabitable through no fault of yours. The court could then find that you were evicted you before the end of the lease - and the lease is therefore terminated.

This is not easy to prove, however. From your three line question I sure can't tell if you have a case or not.

Good luck.
