Legal Question in Real Estate Law in Minnesota
Hi - Are city council members required to following a process when installing sidewalks in the city? The city sent out notices to the homeowners to attend a public meeting for a sidewalk that was going to be placed on the North side of the street. Shortly after the meeting the project was let out for bids for the sidewalk going on the South side (which is my side). The homeowners were never notified of the change to the south side - no public meeting - nothing in the paper. Bids were received and opened last week and this week the contractor's crew is marking for the sidewalk installation. When the city council changed the location of the improvements shouldn't they have been obligated to notify the homeowners? I have 4 large trees that will end up being along the top edge of the sidewalk and when they start to dig the root system will be destroyed - killing the trees. These trees have provides us with privacy, shade in the summer and protection from wind in the winter. As a homeowner, do I have any rights? Any guidance you can provide will be greatly appreciated.
