Legal Question in Real Estate Law in Minnesota

Contract for deed still fulfilled if house condemned?

We sold our mobile home three years ago on a contract for deed agreement in writing. The woman has been paying in a somewhat agreed upon fashion, sometimes late. She purchased a new home but allowed someone else in her family to take over her agreement with me, nothing in writing, never asking for my permission. She has still been contacting with me and taking the payment this person pays her and sending it off to me. She just informed me that the State of Minnesota stopped in for a random housing inspection and told this person that the house is in nonlivable condition. She said that state most likely will be condemning the house and she is sorry for my bad news. We sold the house in perfectly fine living condition three years ago. Is she still responsible for fulfilling her agreement with me if the state condemns the house even though there is no fault from me? There is about $3000 left owed on it. Please help!

Thank you.

Re: Contract for deed still fulfilled if house condemned?

A mobile home would not be transferred by deed but by bill of sale, so I don't get how you could be using a contract for deed.

So I begin reading your story with a problem in understanding what you did, and then it gets worse from there. Your situation clearly calls for the involvement of a lawyer. My contact info is at http://www.kelly-law.com.
