Legal Question in Real Estate Law in Minnesota

contract for deed

Do you have to have the house finished before you sign a contract for deed? If their is verbal between parties about a contract for deed, would that stand up in court? How should we go about getting contract for deed? What if you sign something between the parties that they will sell the house to us when it is finished, instead of contract for deed, would that be good enough until we got the contract for deed signed? Thank you

Re: contract for deed

A contract for deed is a tool for transferring ownership, and usually has nothing to do with anything being built.

You could do a contract for deed while construction is in progress, but then I would caution you to do a written contract about the construction job to cover all the details of that.

Verbal contracts about real estate are usually not enforceble. If it's about real estate, it has to be in writing.

What if you sign something between the parties that they will sell the house to us when it is finished? That would be a combination purchase agreement and construction contract - and it's very common. Builders do them all the time. It would not be a bad idea.

How should we go about getting contract for deed? If you need one, it would be a mistake to go anywhere but to a lawyer. It's not clear to me that you do need one.
