Legal Question in Real Estate Law in Minnesota

Contract for Deed

I sold my home on a contract for deed in November of 2005. I have just been told by a friend who happened to go past the house, that the buyer is selling the home. Can he do this legally since my name is still on the deed?

Re: Contract for Deed

Assuming one of the commonly used "form" contracts for deed was used, he can sell the vendee's interest in the property. You retain the vendor's interest. You retain your rights under the contract for deed, including the right to strict foreclosure if the vendee's responsibilities are not performed.

I'm assuming that the contract for deed was recorded in the register of deeds's office for that county. If it was not recorded, your title to the property is at risk and you should talk with a lawyer about quickly recording the contract for deed.
