Legal Question in Real Estate Law in Minnesota

Imminent Domain

I own a rental house next to the University of Minnesota in Minneapolis. I recently purchased the house and have an appraisal. If the school were to excericise imminent domain and force me to sell it to them, are they requred to pay me the amount of the appraisal? The appraisal was significantly higher than the tax record.

Re: Imminent Domain

If the U exercises a right of eminent domain they have to pay fair compensation. Your appraisal is probably good evidence, but not binding. The U could hire a different appraiser who might come up with a different number. If the U wants to take your property you will want to consult with an attorney experienced in eminent domain proceedings. The basic statute is Minn. Stat. Chapter 117.
