Legal Question in Real Estate Law in Minnesota
liens
I recently received a letter from an attorney I had 9 years ago that stated he was going to foreclose on liens he had put on my house. I didn't know anything about them. Can he do this? He said I should refinance and then he wouldn't bring me to court. I did owe him some money at the end of my divorce but that was 9 years ago. Is there a statute of limitations on doing something like this. He is asking for way more than I owed him.

Re: liens
There are now notice requirements before a lawyer can put an attorney lien on real estate; but 9 years ago there were not; and based on the limited information in your question, I have to say yes he probably can do that.
There is case law, however, that says that the lawyer can't put a lien on your homestead - the place where you live. If you are talking about a lien on your home, you might be able to get it thrown out. This would have to be the place you are living now, not just where you used to live.
You need to consult a lawyer. My consultation fee is $150. Call me at 952-544-6356.
