Legal Question in Real Estate Law in Minnesota
I live in Monticello, Minnesota and have lived in my present house for nearly 21 years. We have just been informed that Northern Natural Gas Company has an easement on our property. We were never informed of any easements when we purchased this property. There are least 10 to 12 home owners that The Gas Company is just now informing us that they are cutting down trees and moving storage sheds. Which they have already started this process on our block. My questions is since nobody in this neighborhood was not informed of this easement, can we make the city responsible for the replacement cost of our trees or have them lower our taxes for this easement? That was not disclosed to any of us. There are people in this block that have lived here for 25 years down to 2 to 3 month and nobody knew about this easement. It is 37 1/2' wide from the property line on each side. Thanks for your assistance.

Harlan,
Your legal rights need to be determined based on your deed and chain of title. It is possible Northern Natural Gas Company does have a proper easement or it might not. It is impossible to tell that without reviewing the necessary documents.
