living trust

My mother is now a resident of North Dakota and has property in a living trust in Mn. Does this have to be probated and can a Mn lawyer oversee this process or must she use a ND lawyer since she is a resident of ND

If the property is in a living trust, no probate should be required. That is why we set up living trusts in the first place. So, I wonder if it is really in a living trust?
