Lost Check

A tenant pays the rent, and the check was lost. Is the tenant responsible to help recover or cooperate to resolve the issue in a timely matter? Can these funds be withdrawn from the damage deposit as money owed?

Re: Lost Check

If the check was not cashed, the tenant is obligated to cooperate; however, if the check was lost by landlord, tenant could demand reimbursement for stop-payment on lost check. Whether rent can be paid from damage deposite depends on language of lease.
