Legal Question in Real Estate Law in Minnesota
Paying for a property that is not in your name.
My friend lives in his father's home, the father still owns the home but the son is making the payments. Recently the father was incarcerated and was told that if the son stopped making the payments on the property that he would call the county and have him evicted. My question is, can the father do that? If the property is in the father's name, isn't he legally bound to that property? My friend wants to move out but is afraid to stop making the payments. Any help on this matter would be greatly appreciated. Thank you.

Not sure that I understand the question. If the son does not have a contract with anyone he does not have to pay anyone. Does he have a lease with father? Did he "assume" the mortgage? No contract with anyone means no liability to continue to make the payments. As to the father, if someone doesn't make the payments, the property will be lost to the mortgage company.
