Legal Question in Real Estate Law in Minnesota
Property line dispute started with gov. marker in wrong location
purchased property in 1970 since found out A goverment marker was located wrong years ago, Since new surveys have been done the entire neighborhood has seen their property lines shift to the south about 70 feet. IN 1992 this was brought to our attention when a neighbor to our north surveyed and sold there property. We clearly had maintained and planted trees on this 70 foot section of property, but were told that to keep this section we would have to purchase it from the property owner to the north and we did. we recently had our property surveyed and yes we now own 70 feet of the property to our south. Do we legally own this 70 ft. like we were told, or/and is he required to buy it from us or do we have any other options?

As with a lot of legal questions, the answer is "it depends." If your neighbor treated the land in question as his own for a long time, he may have an adverse possession claim against it. This applies, however, only to abstract property, and not to Torens property.
You would be very well advised to consult a lawyer. Good luck.
