Legal Question in Real Estate Law in Minnesota

Real Estate & Renters

We rented out a house we thought we were legally buying. The person we bought it from legally could not sell it, defaulted on the payment and the original owner repossessed the house with the renters in it. He collected the rent until they moved. The renters now want the deposit back from us and not the owner. Who is liabel for returning the deposit?

Re: Real Estate & Renters

If you accepted the deposit and rented the home, you are liable for that deposit to the renter. Your may have a remedy against the seller for fraud or breach of contract for selling a home they did not own.
