Return of property taken and stored by former landlord

My former landlord in Minnesota locked up and took my property without going through the eviction process, while I was in California looking for a job. He used the guidelines that it was abandoned, which it was not.

According to lanlord tenant issues he can't keep my property in lieu of money I may owe. I want to sue him in small claims for my property but no longer live in Minnesota. Can I have my representative go to court for me or is my property gone? Or now that I live in California can I sue him here. I have been trying to get my things back since May of 2001.

You almost certainly can't sue the landlord in California because the court here would lack personal jurisdiction (unless for some reason this landlord has substantial other contacts with California). You would also have service and collection problems.

I can't comment on the merits of your case because Minnesota law would govern and I'm a California lawyer, but if there is to be a suit at all it would almost certainly have to be in Minnesota. Sorry.

The matter will have to be tried in Minnesota. And someone may be able to put the matter on for you by assigning the property to them, and then present your testimony by written declaration.
